Counsellor for the Crown presented evidence that Mr Burchall was operating his vehicle at an illegal speed limit and failed to maintain a safe distance from the vehicle in front, actions that allegedly caused the fatal impact. The prosecution also argued that the driver’s failure to yield contributed to the severity of the incident.
Mr Burchall denied the allegations during the initial appearance, stating that he had no intent to endanger other road users. He was remanded for the next hearing scheduled in early December, with the court noting that the case would proceed under the jurisdiction of the Road Traffic Accident Board.
